When placing an order through collaborationoftime.com, you agree to our terms and conditions as a business and a shop.

 

You should check this page regularly to take notice of any changes we may have made to the Terms of Service. Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire Website.

Definitions

For the purpose of these General Terms and Conditions, the following terms shall have the following meanings:

COT Amsterdam means Collaboration of Time B.V., a private limited liability company (besloten vennootschap met beperkte aansprakelijkheid) incorporated under the laws of the Netherlands. COT’s office is registered at Raadhuisplein 342, 2132 TZ Hoofddorp, the Netherlands and/or its group companies;

COT Shop means the webshop of COT on www.collaborationoftime.com;

COT Website means the website of Collaboration of Time B.V. (or COT);

 

Consumer means any natural person not acting in the course of a profession or business (consument) that enters into an Agreement with COT via the COT’s Online shop;

Parties means COT and the Consumer collectively;

General Terms and Conditions means these General Terms and Conditions of COT;

Agreement means any agreement with respect to orders placed for Products available on the COT shop concluded between COT and the Consumer via the COT shop (overeenkomst op afstand);

 

Product means all goods COT produces and/or sells under – inter alia – the (trade)name ‘COT’ and/or ‘Collaboration of Time B.V.’.

 

Business Day means a calendar day, other than a Saturday, a Sunday or a Dutch public holiday, on which the banks in the Netherlands are open for normal business;

Intellectual Property Rights means all existing and future intellectual property rights, subsisting anywhere in the world, whether registered or not (including but not limited to all trademark rights, trade name rights, patent rights, copyrights, database rights, design rights, and all trademarks, trade names, domain names, software, patents, works, databases, designs, models, know-how, and all rights in respect of any of the foregoing) relating to the Products and the COT Website;

DCC  means Dutch Civil Code (Burgerlijk Wetboek);

Durable medium means any instrument, including email, which enables the Consumer to store information addressed to him in a way accessible for future reference for a period of time adequate for the purposes of the information, and which allows the unchanged reproduction of the information stored;

 

Applicability

Terms of use & agreements

Welcome to the COT Shop. These General Terms and Conditions apply to any Agreement (and/or changes or additions there to) for the sale and delivery of Products concluded through the COT Shop. By placing an order, the Consumer agrees to be bound by these General Terms and Conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force major for which we will not be responsible.

These General Terms and Conditions also apply to and form integral part of all quotations and offers made by COT Amsterdam and all acceptances, acknowledgements and confirmations by COT Amsterdam of any orders made by the Consumer.

 

The Agreement

Subject to the provisions of these General Terms and Conditions, the Agreement becomes effective upon acceptance of an offer and the fulfilment of the applicable conditions by the Consumer. The Consumer accepts the offer by placing an order through the COT Shop. After receiving an order, COT Amsterdam will send an automated email confirming the receipt of the order.

COT Amsterdam may obtain information, within statutory frameworks, about the Consumer’s ability to fulfil his payment obligations, as well as about facts and factors that are important for the responsible conclusion of the Agreement. COT Amsterdam reserves the right to reject or cancel an order, without being liable for any damages or costs in (among others) the following situations:

 

  • The Product is not available or the Product is out of stock;
  • The order is flagged by COT Amsterdam’s security systems as an unusual order or an order susceptible to fraud;
  • The Consumer’s billing information is not correct or not verifiable;
  • COT Amsterdam has reason to believe the Consumer is a reseller;
  • There was an error in the price displayed on the COT Amsterdam’s Website;
  • COT Amsterdam cannot deliver to the shipping address provided by the Consumer.
  • In such event the Consumer will be informed by email and any payments with respect to the order will be refunded.

 

Privacy

COT Amsterdam will process personal details of the Consumer in accordance with the privacy statement published on the COT Website.

You are responsible for the accuracy of your personal information on this website and on your order. This includes but is not limited to your name, email address, credit card information, and address. By submitting your personal information to COT Amsterdam you declare that you are the lawful owner and user of this information. COT Amstedam has the right to charge you with any costs resulting from inaccuracies of this information.

 

Changes

Changes to our terms and conditions

We may, from time to time, change the terms that govern your use of our Site. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We may change, move or delete portions of, or may add to, our Site from time to time.

We reserve the right to modify this statement at all times.

 

Product information

All product designs are made by COT Amsterdam. The website is based on an Uncode template via Wordpress and all photography rights are reserved by COT Amsterdam.

We try to display the products as accurate as possible. Due to devices like monitor, mobile phone, tablet, as such, the appearance of the products can vary. We cannot guarantee that your devices will display our products on an accurate way.

 

Delivery

Purchased Products will be dispatched within 5 Business Days of the order, although aimed for 1 to 2. Please allow COT Amsterdam to deliver within 2 weeks to arrive (outside of the Netherlands), and 3 days within The Netherlands. If you still have not received your purchase after 3 weeks, please notify COT Amsterdam via info@cot.amsterdam.

 

In the event that multiple orders with the same shipping address are placed by the Consumer, these orders may be combined, unless otherwise requested by the Consumer. In such event the Products will be shipped to the Consumer within 5 Business Days after the last order.
COT Amsterdam ships to shipping addresses in the countries indicated on the COT Website. COT Amsterdam will deliver the Product(s) at the shipping address specified in the order of the Consumer.

If the shipping address is located outside the European Union, the Consumer shall be responsible for assuring that the ordered Products can be lawfully imported.

COT Amsterdam is authorised to engage third parties in the fulfilment of its shipping and delivery obligations under the Agreement. All shipping services used by COT Amsterdam provide a tracking number.

 

The buyer assumes any and all duties and customs costs for orders shipping outside of the Netherlands /Europe and will be contacted in advance should additional charges need to be made. COT Amsterdam is not responsible for any lost, stolen or damaged shipments. All domestic shipments are sent with a delivery confirmation and the buyer assumes all responsibilities of lost items.

COT Amsterdam retains the full and unconditional ownership of the ordered Product until the Product as well as all other claims of COT Amsterdam vis-à-vis the Consumer are paid in full (within the meaning of article 3:92 and 7:9 DCC). All risks in connection with the Product shall pass to the Consumer when the Product is delivered at the shipping address specified in the order of the Consumer. If the Consumer refuses or fails to take and/or accept delivery of the ordered Product, the Consumer will be charged the actual costs of shipping the Product back to COT Amsterdam.

 

Price, shipping and handling charges

All prices are in Euros and include handling or taxes (total at end) excl. shipping, if delivered to customers within Europe. For customers outside Europe, additional charges may apply. Please contact COT Amsterdam if this is the case via service@collaborationoftime.com.

COT Amsterdam reserves the right to change the prices quoted on the COT Website without notice. COT will not be liable to the Customer or any third party for price changes.
If we discover an error in the price of any goods that you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

 

Payments

COT Amsterdam does not accept any other method of payment than the payment methods indicated on the COT Website. COT Amsterdan may change these payment methods at any time. All actual costs of payment will be passed on to the Consumer. For international orders COT Amsterdam only accept PayPal and Credit Card via Stripe. This way both parties are sure for an good and trustable transaction and deal. For orders within the Netherlands, both PayPal and iDeal are possible.
The Consumer has the duty to inform COT Amsterdam of any inaccuracies in payment data provided or stated.

 

Product availability

COT Amsterdam does not guarantee that the COT Website, or any content on it, will always be available or that access will always be uninterrupted.

For this reason COT Amsterdamm reserves the possibility to, once received the order, to verify availability of the good and, in case of loss, to hurry comunicate the loss of order acceptation.
COT Amsterdam shall not be liable for any reason due to which the COT Website is unavailable at any time or for any period.

 

Return policy

Our return policy entitles you to return the Product for any reason within 14 calender days counting from the day you received the shoes. The package of the Product(s) and the Product(s) can be checked. However, the Product(s) can only be returned when they are completely unused and sent in the original packaging and double boxed. The Consumer shall be liable for any diminished value of the Product resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Product.

If the Consumer exercises its right of withdrawal, the Consumer will return the Product to COT Amsterdam at its own risk and expense, without undue delay and in any event no later than 14 calendar days from the day on which the Consumer communicated his decision to withdraw to COT Amsterdam. This deadline is met if the Consumer sends back the Product before the withdrawal period of 14 calendar days has expired. If the Consumer is located outside the European Union, the Consumer shall declare the returned Product as “Returns and Repairs of Dutch Merchandise” on the customs declaration.

 

To exercise the right of return the Product, the Consumer must inform COT Amsterdam of his decision to withdraw from the Agreement via info@cot.amsterdam within the period.

To meet the withdrawal deadline, it is sufficient for the Consumer as soon as possible.

If the Consumer timely exercises its right of withdrawal, COT Amsterdam will reimburse the relevant payments received from the Consumer, including the costs of delivery, without undue delay and in any event not later than 14 calendar days from the day on which COT Amsterdam is informed of the Consumer’s decision to withdraw from the Agreement. COT Amsterdam may withhold the reimbursement until COT Amsterdam has received the Product back, or until the Consumer has supplied adequate evidence of timely having sent back the Product, whichever is earliest. COT Amsterdam will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise.

 

Shipping and Handling costs are not refundable. Return shipping costs are at the Customer’s expense.

COT Amsterdam is entitled to refuse to accept a returned Product and the reimbursement of payments if the Consumer does not comply with the instructions of this clause.

 

Content protection

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that appear as part of COT Website (collectively, the “Contents”) are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by COT Amsterdam. the COT Website as a whole is protected by copyright and trade dress, all worldwide rights, titles and interests in and to which are owned by COT Amsterdam.

The Contents of the COT Website, and the Website as a whole, are intended solely for personal, noncommercial (other than for the purchase of merchandise from our site) use by the users of our Site. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software.

Liability

COT Amsterdam is not liable for any damages directly or indirectly, after the delivery by any cause whatsoever caused to the buyer at the buyer’s business, to family buyers, to others or to property of third parties. If it is established that the seller could be held liable for any damage, liability is capped at the order of the order and never more than € 200 in total. COT Amsterdam is not liable for the non-availability of permanent www.cot.amsterdam or for technical or electronic errors on the site.

 

 

Complaints

The Consumer shall inform COT Amsterdam of any complaints about defects and/or non-compliance with the specifications of the delivered Product, including but not limited to complaints in respect of visible defects and/or damages of the Product and/or the colour of the Product. Any complaints shall be sent to the following email address: info@cot.amsterdam. The email shall contain a clear description of the complaint, the Consumer’s name, the order number included in the order confirmation and the article number(s) of the Product(s) and shall be sent within a reasonable time after the discovery of the defects, but in any case no later than two (2) months after the discovery of the defects.
Complaints submitted to COT Amsterdam will be replied within a period of five (5) Business Days, from the date of receipt of the complaint.

COT Amsterdam will assess the complaint. If COT Amsterdam assesses the complaints as justly, the Consumer shall be entitled to either replacement or repair of the defective or non-conforming Product(s), or an appropriate credit for the purchase price of the Product(s).
The Consumer shall return the defective or non-conforming Product in its entirety to COT Amsterdam. The return costs are for the account of the Consumer. The defective or non-conforming Product shall become COT Amsterdam’s property as soon as it has been replaced or credited.

A complaint that does not meet the requirements set out in this clause, shall not be taken into consideration by COT Amsterdam. the Product(s) shall be deemed to have no defects and conform to the specifications and does not release the Consumer from any of its obligations under the Agreement.

 

Miscellaneous

Unless otherwise specified and except to the extent COT Amsterdam Product(s) are offered for sale in the Netherlands through this Website, this Website and the Contents thereof are displayed solely for the purpose of promoting COT Amsterdam products and services available in The Netherlands and select foreign markets. This Website is controlled and operated by COT Amsterdam from its office in Amsterdam, The Netherlands.

This Agreement shall be construed in accordance with the laws of the Netherlands, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the The Netherlands.

 

Intellectual property rights

The intellectual property rights in all software and content made available to you on or through this Website remains the property of COT Amsterdam and are protected by copyright laws and treaties around the world. All such rights are reserved by COT Amsterdam. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise. You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by COT Amsterdam. No license or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks, which are similar without the written permission of COT Amsterdam.

 

Governing law and jurisdiction
